  • DEA Confirmation: As of January 6, 2022, the Drug Enforcement Administration (DEA) confirmed that cannabis seeds containing less than 0.3% ∆9-THC do not meet the definition of a controlled substance under the CSA.
  • Interstate Commerce: The interstate transfer of hemp, including cannabis seeds, is protected under 7 U.S.C. § 1621 subsection 10114(b). Federal law preempts any state or tribal law that may otherwise interfere with the transportation or shipment of compliant hemp products.
